Welcome to Schoolenco ("Platform", "we", "us"). By accessing or using our website, mobile application, or services, you agree to be bound by these Terms and Conditions ("Terms").
Please read these terms carefully before ensuring compliance with the Information Technology Act, 2000 and other applicable Indian laws. If you do not agree with any part of these terms, you must not use our services.
1 Definitions
- "User", "Client" or "School": Refers to the educational institution, principal, or administrator registering an account to use our services.
- "Student Data": Refers to any personal information of students, parents, or staff uploaded to the platform by the User.
- "Service": Refers to the SaaS (Software as a Service) platform provided by Schoolenco for school management.
2 Account Registration & Minor Consent
To use our Service, you must register for an account. You agree to provide accurate, current, and complete information. If you are a student under 18 years of age (a "Minor"), you may only use or subscribe to the platform with the direct verifiable consent and involvement of a parent or guardian, in compliance with the DPDP Act.
Your Responsibility
Schools remain strictly responsible for obtaining initial parent consents for minors onboarded via the School. You are solely responsible for safeguarding your account login credentials. Schoolenco will not be liable for any loss arising from unauthorized access due to failure to secure your password.
3 Subscription, Fees & Refunds
- Billing Model: The Service is billed on a per-student, per-year basis, or via modular add-ons (like CRM, Inventory, and Timetables) as per the specific plan chosen.
- Student Subscriptions: Parents/Students purchasing direct digital subscriptions are subject to specialized consumer terms presented at the time of checkout.
- Payment: All fees are payable in advance. GST is applicable as per Indian government norms.
- Late Payment: Failure to renew may result in suspension of access until dues are cleared.
Refund Policy
For B2B/School enterprise plans, SchoolEnco follows a strict "No Refund" policy once a subscription is activated.
A 30-day free trial is provided to evaluate the platform, features, and suitability. By proceeding with payment after the trial period, the customer acknowledges full satisfaction with the platform.
The platform operates on a modular pricing structure. Certain advanced features, including but not limited to Transport Tracking, Enquiry CRM, Inventory, and other AI-enabled modules, may be offered as paid add-ons and are not included in the base subscription unless explicitly stated in writing.
Any verbal or informal communication shall not be considered a binding commitment. Only written agreements or officially documented inclusions shall be valid.
No refunds shall be issued on the basis of feature assumptions, partial usage, or change in requirements after activation.
4 Data Privacy & Ownership
We respect the data privacy principles under the Digital Personal Data Protection (DPDP) Act of India.
Ownership
The School retains full ownership of all Student Data. Schoolenco claims no intellectual property rights over the data you upload.
Data Processing
Schoolenco acts solely as a "Data Processor". The School acts as the "Data Fiduciary" and is responsible for obtaining necessary consents from parents/guardians.
5 Limitation of Liability
Please read this section carefully.
To the maximum extent permitted by Indian law, Schoolenco shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
In no event shall Schoolenco's total liability exceed the amount paid by you for the Service in the past six (6) months.
6 Prohibited Use
You agree NOT to:
- Reverse engineer, decompile, or disassemble the source code.
- Use the platform for any illegal activities under Indian Penal Code (IPC).
- Use our CRM or communication features for sending unsolicited spam (SMS/Email) that violates TRAI guidelines or IT Act provisions.
- Upload viruses, malware, or harmful code.
- Share your account credentials with unauthorized third parties.
7 Termination
We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
8 Governing Law & Jurisdiction
These Terms shall be governed and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi / Noida.
